I believe they can still attempt to collect even though the statute of limitations is passed, they can even sue you in court, they just cannot win if you show up to defend yourself and state the appropriate defense. If phone calls become a problem, debt validation request can temporarily stop the phone calls. When the two merged, T-Mo sold it to or placed it with ERC. I would suspect that Sprint never sold that debt or made much of an effort to collect it. ![]() Even if they don't use that language, the statute of limitations is always a defense to getting sued so I don't see the benefit of interacting. I feel like they might be one of the ones who actually uses language like, 'Your debt is beyond the statute of limitations so we won't sue you.' If this is the case and it's not on your credit report, I don't see the benefit to interacting whatsoever. I don't feel like heading downstairs to grab my papers but from my understanding T-Mobile sold an alleged debt of mine to ERC a while back. I was just wanting to see if anybody here in this sub had seen anything like this recently, wondering if there was an uptick in this when Sprint became part of T-Mobile. This is also sent to an address different from the one that Sprint would have had. The notice was addressed only to her, under her old last name, which was also spelled incorrectly on both the notice, and the ERC website which I found for myself after seeing the notice and doing a little bit of research. The Sprint account was in both of their names. Her and her then husband switched to prepaid plans with other companies for financial reasons. The last time she had a Sprint account was right around 9 years ago, and to the best of her knowledge, was in good standing when her contract ended. The notice claimed that her bill remained unpaid, and that the amount was over $200, but that they would settle with it for just over $100. ![]() Today my wife recieved a notice in the mail from ERC, clamining that they were collecting a debt with the original creditor listed as Sprint, a subsidiary of T-Mobile. Never seen anything like this, though I know that ERC seems to be an actual collections organization, and so I'm not sure if this is better suited to be posted on r/scams or here, so here goes. ![]()
